  1. INTRODUCTION

    1. Jacqui E Pty Ltd A.C.N 004 353 379 and Kimbyr Investments Ltd company number 205268 (“Jacqui E”) run a loyalty program known as Jacqui E VIP ("Program"). These terms and conditions replace the previous terms and conditions and form the basis of the Program and govern the use of the plastic Jacqui E VIP card (“Card”) from 17 August 2009.
    2. By applying for or using the Card you ("Cardholder"):
      1. agree to be bound by these terms and conditions and any variations to them;
      2. agree to participate in the Program; and
      3. agree to receive information and promotions via mail, e-mail and SMS (where you have provided such information).
  2. MEMBERSHIP

    1. To participate in the Program, you will need to be issued with a Card.
    2. To obtain a Card from 17 August 2009, you will need to have spent NZD$150 or more in one transaction in a New Zealand Store (excluding factory outlets) or AUD$150 or more in one transaction in an Australian Store (excluding factory outlets, Jindalee and Spencer Street exempted) on or from 17 August 2009, legibly complete and sign the registration form
      1. and hand it to a sales person in Store. (excluding factory outlets stores, Jindalee and Spencer Street exempted) You will then be issued with a Card in store.
    3. Applicants can only be eligible for one Card each and the issuing of a Card and disqualifying of a Card, Cardholder or participant in the Program are at Jacqui E’s sole discretion.
  3. THE JACQUI E VIP CARD

    1. The Card is for personal use only and is not transferable. Jacqui E is entitled to regard the person presenting the Card as the Cardholder.
    2. It is the Cardholder’s responsibility to keep the Card safe and Jacqui E is not responsible for stolen, lost or damaged Cards or the failure of a Cardholder to provide the Card at the time of making a purchase.
    3. If a Card is lost or damaged, you may apply for a replacement Card by emailing jefeedback@jjh.com.au.
    4. The Card and vouchers in relation to the Program at all times remain the property of Jacqui E.
    5. If you do not have your Card with you to be scanned, you can quote your membership number (starting with a "Q") which can be found at the back of your Card or present the plastic keytag issued with the Card. By using your membership number or plastic keytag, you are bound by these terms and conditions as if you are using your Card.
  4. 15% OFF VOUCHERS

    1. A, voucher will be provided to new members, entitling the member to have 15% deducted from the total purchase price of one transaction upon presentation of the voucher ("Welcome Voucher")
    2. A Welcome Voucher issued under the Program on or from 17 August 2009:
      1. Is valid for use at Stores for six weeks from the date of issue;
      2. Can only be used once and must be handed over at time of purchase;
      3. Cannot be used with another Welcome Voucher in the same transaction and cannot be used in conjunction with any other offer;
      4. Does not apply to accessories or already reduced merchandise or the purchase of gift cards
      5. Will not be replaced if lost or stolen.
  5. OTHER REWARDS AND PRIZES

    1. As a Cardholder you may have the chance to win prizes and receiveoffers. Competitions and other offers will be subject to their own terms and conditions which will be available in store and at www.jacquie.com.au or www.jacquie.co.nz. Competitions and offers may limitcertain Cardholders from entering and/ or claiming a prize or offer.
    2. You may also be informed of offers, promotions or benefits from time to time including from third parties, which will be subject to their own terms and conditions. Jacqui E acts as conveyers of any information from third parties which Jacqui E expects to be of benefit to you and Jacqui E does not take any responsibility for the third party, their offer, promotion or benefit.
  6. CANCELLATION/ CHANGE OF DETAILS

    1. If you no longer wish to participate in the Program or receive the information or offerings, you can withdraw from the Program by notifying Jacqui E in writing and returning the Card to the Customer Service Assistant at

    2. If your details change, please contact Jacqui E in writing at the address or email above, fill out a form in Store.excluding factory outlet stores, Jindalee and Spencer Street exempted) or log onto www.jacquie.com.au or www.jacquie.co.nz.
    3. Jacqui E reserves the right to vary these participating terms and conditions at any time and to suspend or cancel the Program and the Card at any time upon reasonable notice.
  7. NOTICES

    1. Any notice Jacqui E may wish to provide to the Cardholder shall be regarded as notified to the Cardholder if sent by prepaid post or e-mail addressed to the Cardholder’s address provided in the application form or as otherwise notified in writing by you to Jacqui E.

    2. The purpose for Jacqui E collecting your personal information is for you to participate in the Program. This privacy statement and these terms and conditions form part of each other. For the purposes of operating the Program, Jacqui E may provide your personal information to its mailing house and data entry service provider. It will hold your personal information in Australia. If you do not provide us with information required in the enrolment form you may not be eligible to obtain a Card or participate in the Program. If you require a replacement card, Jacqui E may require you to fill out a form and provide such information that Jacqui E reasonably requires. Jacqui E may require prize winners to provide evidence of identity and sign such acknowledgement of receipt as Jacqui E reasonably requires. Please note that the terms and conditions of competitions and other offers will be subject to their own terms and conditions, which will set out how your personal information may be used. We provide your personal information in the case of prize winners to the prize provider and may publish the names and suburbs of winners.
  9. GENERAL

    1. Stores are all Jacqui E stores in Australia and New Zealand.
    2. A copy of the current terms and conditions can be viewed in Stores (excluding factory outlet stores, Jindalee and Spencer Street exempted), at Jacqui E’s registered office in Melbourne at 658 Church Street, Richmond or at www.jacquie.com.au or www.jacquie.co.nz.
    3. Jacqui E will not be responsible for lost or stolen vouchers.
    4. Third parties involved in the program do not have any authority, express or implied, to make any representation, warranty or statement on behalf of Jacqui E and Jacqui E accepts no liability in respect of such representations, warranties or statements
